Article 1 — Purpose and scope

These general terms of use (the “Terms”) set out the terms and conditions under which users access and use the services offered on the CommuniFilms website, accessible at https://communifilms.com (the “Site”).

CommuniFilms is a social media platform for sharing audiovisual creations. It allows works (feature, medium and short films, series and music videos) to be listed, the organizations that produce them to be presented, and lists, reviews, news and listings to be published, as well as interaction between users and, where applicable, the viewing of audiovisual content.

The Terms constitute the contract between the Publisher and the User. They apply to any access to and use of the Site, whether the person is a mere Visitor or a registered member.

Article 2 — Definitions

  • Publisher: the company that publishes the Site, identified in Article 3.
  • Site: the online service accessible at https://communifilms.com and all of its pages and features.
  • Visitor: any person consulting the Site without being identified by an account.
  • User: any natural person holding a personal account, identified by their first and last name.
  • Organization account: a space created, from a personal account, to present a company, association, institution or collective.
  • Content: any data, information, text, image, poster, photograph, video, note, review, comment or listing published on the Site.
  • Film page: the page dedicated to an audiovisual work listed on the Site.
  • Message: any publication posted by a User on their feed.
  • Group: an exchange space created by a User, of the “discussion” (public) or “work” (private) type.

Article 3 — Publisher of the Site

The Site is published by Les Films du Siou Blanc, a SARL with share capital of €10,000, registered with the Toulon Trade and Companies Register under number 538993924 (SIRET 53899392400025), whose registered office is at Espace Albert-Camus, La Coupiane, 83160 La Valette-du-Var, France. Intra-Community VAT number: FR29538993924.

Article 4 — Acceptance and amendment of the Terms

Accessing the Site as a Visitor constitutes acceptance of these Terms. Creating an account is subject to express acceptance of the Terms, by ticking a box during registration. Anyone who does not accept the Terms must refrain from creating an account and using the services.

The Publisher reserves the right to amend the Terms at any time, in particular to adapt them to changes in the Site or in regulations. The applicable Terms are those in force on the date of access to the Site. In the event of a substantial change, registered members are informed by appropriate means; continued use of the Site after such notice constitutes acceptance of the amended Terms.

Article 5 — Access to the Site and statuses

Visitor. The entire Site can be viewed without creating an account. A Visitor may view film, user and organization pages, but may neither interact with members nor publish, like, comment, rate, leave a review, or view content with restricted access.

User. Registration allows interaction with other members and the publication of content. On CommuniFilms, the User is not anonymous: they identify themselves by their real first and last name. Each User chooses one or more statuses (participant in a work, professional in a related field, or viewer).

Organization account. An organization account may be created, only from a personal account, to present an entity. The person who creates an organization account warrants that they have the power to represent that entity and to act on its behalf.

Article 6 — Registration and account

Creating an account requires providing the mandatory information in the registration form (first name, last name, email address, username, password, location). The User undertakes to provide accurate, truthful and up-to-date information, and to keep it updated in the event of change.

Minimum age. The Site is reserved for persons aged at least 15. Minors under 15 may not register. Any minor User declares that they have the authorization of the holders of parental authority.

Security. The User is responsible for the confidentiality of their credentials and for any activity carried out from their account. They must inform the Publisher without delay of any unauthorized use. An account is strictly personal; identity theft and the creation of accounts under a false identity are prohibited.

Article 7 — Description of the services

With their account, a User may in particular create and publish:

  • film pages, whose content appears in their filmography;
  • organization pages (production company, organization, media outlet, etc.);
  • lists of films, series or music videos;
  • reviews, ratings and comments;
  • messages on their feed, as well as listings (casting call, call for projects, call for films, etc.) specifying the activity sought and the area concerned;
  • discussion groups (public) or work groups (private), within which members may exchange messages, documents and audiovisual content.

The Publisher reserves the right to change, add or remove all or part of the services, in particular features announced as “coming soon”, without this giving rise to any right to compensation.

Groups. The private nature of a work group in no way exempts its members from complying with these Terms, in particular Articles 8 and 10. The Publisher may remove Content or dissolve a group, including a private one, whose Content is reported to it as manifestly unlawful or contrary to the Terms. The person who creates a group is responsible for running it and for the Content shared within it.

Article 8 — Publishing a work and warranty of rights

To create a film page, the User must be the rights holder (producer) of the work or, if a member of the crew, declare that they have obtained the authorization of the rights holder.

By publishing Content (page, poster, photograph, trailer, work, text, etc.), the User warrants:

  • that they hold all rights and authorizations necessary for its publication and distribution on the Site, including the rights of authors, performers, rights holders and persons represented (image rights);
  • that the Content does not infringe any third-party right or any legal or regulatory provision;
  • that they have obtained, for any person identified in a film page, the required authorizations before mentioning them or sending them an invitation.

The User indemnifies the Publisher against any claim, complaint or action by third parties based on Content they have published, and bears the resulting financial consequences.

Article 9 — Nature and distribution of audiovisual content

CommuniFilms is dedicated to promoting audiovisual creations: films (feature, medium or short), series (television or web series) and music videos. Works falling under audiovisual services (corporate films, advertising) are not among the admitted content.

Depending on the wishes of the rights holder, audiovisual content may be offered: with free access via a YouTube or Vimeo link; with private access protected by a password and authorized by the rights holder alone; or with restricted access, available on video on demand on a dedicated site. The rights holder remains solely responsible for the conditions of availability they choose.

Article 10 — Rules of conduct and prohibited content

The User undertakes to use the Site fairly and refrains in particular from publishing or distributing any Content that is:

  • unlawful, contrary to public order or public morality;
  • infringing intellectual property rights, privacy, image rights or the honor of third parties;
  • defamatory, insulting, hateful, discriminatory, violent, or inciting hatred or discrimination;
  • pornographic or harmful to minors;
  • condoning or denying crimes against humanity (Holocaust denial), condoning terrorism, or inciting the commission of crimes or offenses;
  • false, misleading, or constituting identity theft;
  • unsolicited advertising, abusive promotion or spam.

These prohibitions apply to all Content, including the audiovisual works listed, their visuals (posters, photographs) and the texts, notes, reviews and comments.

The User also refrains from any action likely to disrupt the operation of the Site, compromise its security, or collect other members’ data without their consent.

Article 11 — Intellectual property

Site elements. The “CommuniFilms” trademark, the logo, the graphic charter, the architecture, the databases and the developments of the Site are the property of the Publisher or are subject to a license. Any unauthorized reproduction, representation or extraction is prohibited.

User content. Each User retains ownership of the rights to the Content they publish. By publishing it, they grant the Publisher a non-exclusive, free license, for the duration of its posting, for the sole purpose of hosting, reproducing, representing and making this Content accessible in connection with the operation and promotion of the Site. This license ends, subject to technical delays and legal retention obligations, when the Content or the account is deleted.

Article 12 — Moderation and reporting of unlawful content

In its capacity as host within the meaning of French Act No. 2004-575 of 21 June 2004 on confidence in the digital economy, the Publisher is not subject to a general obligation to monitor Content published by members. It may nevertheless carry out moderation a priori or a posteriori.

Any manifestly unlawful Content may be reported to contact[at]communifilms[dot]com, or through the reporting tools provided on the Site. The report must specify the identification of the Content concerned, the reasons why it should be removed, and the contact details of the person making the report.

After review, the Publisher may remove or make inaccessible any manifestly unlawful Content or Content contrary to the Terms and, where applicable, inform its author. These provisions apply without prejudice to the obligations arising from Regulation (EU) 2022/2065 (Digital Services Act).

Article 13 — Personal data

The processing of personal data carried out in connection with the Site is described in the Privacy Policy, accessible from the Site, which forms an integral part of the contractual framework. The User has the rights of access, rectification, erasure, restriction, objection and portability provided for by Regulation (EU) 2016/679 (GDPR), which they may exercise under the conditions specified in that Policy.

Article 14 — Liability

The Publisher endeavors to ensure the accessibility and proper functioning of the Site, without guaranteeing uninterrupted availability. Access may be suspended for maintenance or update operations or in the event of force majeure.

The Publisher is not the author of the Content published by members and does not guarantee its accuracy, legality or quality. The Publisher’s liability cannot be engaged on account of members’ Content, subject to its obligations as host. The User is solely responsible for the Content they publish and for the consequences of its distribution.

The Site may link, in particular through YouTube or Vimeo viewing links, to third-party sites over which the Publisher exercises no control; it disclaims all liability as to their content and practices.

Article 15 — Suspension and deletion of an account

In the event of a breach of the Terms, in particular Articles 8 and 10, the Publisher may, depending on the seriousness and without notice in the event of a serious breach, issue a warning, remove Content, suspend or delete the account concerned. These measures are without prejudice to any legal action and to compensation for the harm suffered.

The User may delete their account at any time from their personal space. Deletion of the account results in the cessation of access to the services and the deletion or anonymization of the associated Content, subject to legal retention periods.

Article 16 — Governing law and dispute resolution

These Terms are governed by French law. However, a User acting as a consumer and residing in another country retains the benefit of the mandatory, more protective provisions granted by the law of their country of residence. In the event of a dispute, the parties will seek an amicable solution before any legal action; any complaint may be sent to contact[at]communifilms[dot]com.

In accordance with Articles L.611-1 et seq. of the French Consumer Code, a User acting as a consumer may use, free of charge, a consumer mediator with a view to the amicable resolution of a dispute with the Publisher. Designated mediator: CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, France. Consumers may refer a dispute online at https://www.cm2c.net, by post to the address above, or by phone at +33 1 89 47 00 14. For a cross-border dispute within the European Union, a consumer User may also contact the European Consumer Centres (ECC) network.

Failing an amicable resolution, any dispute will be brought before the competent French courts. A consumer User nevertheless retains the right to bring proceedings before the courts of their country of residence where the applicable mandatory rules so provide.

Article 17 — Miscellaneous

If any provision of the Terms is declared void or unenforceable, the other provisions retain their full force. The Publisher’s failure to invoke a breach does not constitute a waiver of the right to invoke it later.
